Acceptance of Terms

Welcome to Medjugorje.blog (the “Site“). These Terms of Service (“Terms“) govern your access to and use of the Site, including all content, features, and services offered on or through the Site. By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms (as well as our Privacy Policy which is incorporated herein by reference). If you do not agree with any part of these Terms, you must not use our Site.

These Terms constitute a legal agreement between you (“User” or “you“) and the owner/operator of the Site (“Medjugorje.blog“, “we“, “us“, or “our“). Medjugorje.blog is owned and operated by Jan Binder. The Site is provided for informational purposes to an international audience. Please note that additional terms or disclaimers may apply to certain features of the Site; any such terms will be displayed to you at relevant sections and are incorporated into these Terms by reference.

We reserve the right to modify or update these Terms at any time, at our sole discretion. If we make material changes, we will provide notice by updating the effective date or by posting a prominent notice on the Site. Continued use of the Site following any changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically for updates.

Effective Date: June 2, 2025 (last updated). These Terms of Service apply to all users of the Site from this date until superseded by a newer version.

Eligibility and User Obligations

By using this Site, you represent and warrant that you are at least 13 years of age. The Site is not directed to children under 13, and you may not use this Site if you are under 13 years old. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may use the Site only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. Users under the age of majority must ensure that a parent/guardian has reviewed and accepted these Terms on their behalf.

You agree that you will only use the Site for lawful purposes and in accordance with these Terms. If you create any accounts or profiles on the Site in the future (if such functionality is introduced), you must safeguard any login credentials and not share them; you will be responsible for any activity under your account.

Acceptable Use Policy

We strive to maintain a safe, respectful, and useful website for all visitors. As a condition of your use of the Site, you agree NOT to:

  • Violate Laws or Regulations: You must not use the Site for any purpose that is unlawful or prohibited by these Terms.     • No introducing of viruses, trojans, worms, logic bombs, or any other malicious or technologically harmful material.
    • No attempting to gain unauthorized access to any portion or feature of the Site, other users’ accounts (if any), or any systems or networks connected to the Site or our server. You agree not to probe, scan, or test the vulnerability of the Site or breach any security or authentication measures.
  • Scraping and Automated Access: You must not use any robot, spider, crawler, scraper, script, or other automated means to access, data-mine, or index the Site or its content without our express prior written consent. (Exception: public search engines may use spiders to index materials from the Site for the sole purpose of creating publicly available searchable indices, with our revocable permission.)
  • Impersonation and False Information: You must not impersonate any person or entity, or falsely state or otherwise misrepresent your identity or affiliation with a person or entity when using the Site. This includes not misrepresenting that you are an official representative of Medjugorje.blog or implying any endorsement by us when it does not exist.
  • Intellectual Property Infringement: You must not use the Site to upload, post, or transmit any content that infringes upon any intellectual property or other rights of any party. (Note: Currently, our Site does not allow user-generated content such as comments, so this mainly relates to not attempting to post unauthorized content through any means.)
  • No Spam or Unauthorized Solicitations: You must not use the Site to transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation. The Site’s functionality (e.g., newsletter signup or contact form) must not be used to send mass messages or automated communications for commercial purposes.
  • Malicious or Abusive Conduct: You must not engage in any other conduct that, in our sole discretion, is threatening, abusive, disruptive, or otherwise objectionable or violates any party’s rights. This includes any attempts to disrupt the normal flow of dialogue or cause the Site to malfunction for other users.

If you breach the above Acceptable Use provisions or any other part of these Terms, we reserve the right to take appropriate action, which may include terminating or suspending your access to the Site (see “Termination” below), and if necessary, cooperating with law enforcement or pursuing legal action.

Intellectual Property Rights

All content and materials on the Site are protected by intellectual property laws and are the property of Medjugorje.blog (Jan Binder) or used under appropriate licenses or permissions. This includes, but is not limited to, the text, articles, blog posts, guides, photographs/images, graphics, logos, design/layout, audio or video clips, and the compilation and arrangement of such content (collectively, the “Content“).

Our Content: We retain all rights, title, and interest in and to our Content and the Site. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site and Content for your own personal, non-commercial use only. This means you may read, download, or print content from the Site for your personal pilgrimage planning, research, or educational purposes. However, you must not:

User Contributions: As of now, we do not offer features for users to post content (such as comments or forum posts) on the Site. If in the future we invite user-generated content or contributions, any such content you submit will be subject to separate guidelines and become part of the Site. In general, by submitting any content, you would grant us a right to use, display, and distribute that content as needed to provide the service. (We will update the Terms accordingly if user contributions become enabled.)

Copyright Infringement Claims (DMCA): We respect the intellectual property rights of others. Limitation of Liability

To the extent we may be found liable notwithstanding the above, our aggregate liability to you for any and all claims arising from or related to the use of the Site or these Terms will not exceed the amount of fees you have paid to us (if any) in the 12 months prior to the event giving rise to liability, or $0 USD, whichever is greater. Since our Site is free to use and we typically do not charge users, this monetary cap reflects that limited relationship.

This limitation of liability applies to any claims, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

Exceptions: Nothing in these Terms shall exclude or limit our liability for losses which may not be lawfully excluded or limited under applicable law. In particular, some jurisdictions do not allow the exclusion or limitation of liability for personal injury or death caused by negligence, or for fraud or fraudulent misrepresentation. Also, certain consumer protection laws may not allow the exclusion of certain damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

You agree that any cause of action or claim you may have arising out of or relating to these Terms or the Site must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred (this limitation may not apply in certain jurisdictions that prohibit such shortening of the statute of limitations).

Indemnification

You agree to indemnify, defend, and hold harmless Medjugorje.blog, its owner (Jan Binder), affiliates (if any), agents, partners, and licensors, and their respective officers, directors, contractors, and employees (collectively, the “Indemnified Parties“), from and against any and all losses, liabilities, claims, demands, damages, judgments, awards, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of these Terms or any applicable law or regulation.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you will cooperate with us in asserting any available defenses). Newsletter and Electronic Communications

By providing your email address to subscribe to our newsletter or to receive updates, you agree to receive periodic emails from us regarding Site news, new blog posts, or other information related to Medjugorje and our content. Termination

Termination by Us: We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of the Site at any time, with or without notice, for any reason or no reason. Without limiting the foregoing, we may immediately terminate or suspend your access if we detect or believe that you have violated any provision of these Terms, engaged in any conduct that we deem inappropriate or harmful, or for technical/security reasons. We shall not be liable to you or any third party for any termination of your access to the Site.

Termination by You: You may cease using the Site at any time. If you are dissatisfied with the Site or any content, or with these Terms, or any policies or practices of Medjugorje.blog, your sole remedy is to discontinue use of the Site.

Upon termination, whether by you or us, the following provisions of these Terms will survive: any provisions relating to ownership of intellectual property, disclaimer of warranties, limitation of liability, indemnification, governing law, dispute resolution, and any other provisions which by their nature are intended to survive termination.

If in the future we offer user accounts and your account is terminated or deactivated (by you or by us), your right to access any account-specific content or information will cease, and we may delete your account and content. We are not obligated to provide you with copies of your content or data following termination, except as required by law. (Again, currently no user accounts exist on the Site; this is a precaution for potential future features.)

Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or related to the Site or these Terms (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Ireland, without giving effect to any conflict of law principles. We choose Ireland law in light of serving an international audience and aligning with strong data protection standards, however we do not waive any rights to rely on the laws of another jurisdiction if deemed appropriate.

Jurisdiction: You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the use of the Site shall be brought exclusively in the courts of competent jurisdiction located in Ireland, unless applicable law requires otherwise. By using the Site, you consent to the jurisdiction of such courts and waive any objections to such venue (including any objection based on inconvenience).

Consumers in the EU/UK and Other Jurisdictions: If you are accessing the Site as a consumer (not for business purposes) in the EU, UK, or another country that provides you certain rights to bring claims in your home jurisdiction under local consumer protection or privacy laws, nothing in the above governing law and jurisdiction section is meant to limit your statutory rights to such protections. You may have the right to bring actions in your home country’s courts under that country’s laws if mandatory consumer protection laws so dictate. These Terms operate to the extent permissible under those laws.

Miscellaneous Provisions

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect. In other words, the invalid part will be severed, and the rest of the Terms remain valid and enforceable.

No Waiver: No waiver by Medjugorje.blog of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Similarly, any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. We must expressly waive a provision in writing for it to be waived.

Entire Agreement: These Terms of Service (along with our Privacy Policy and any additional terms or guidelines posted on the Site for specific features) constitute the entire agreement between you and Medjugorje.blog regarding your use of the Site. They supersede all prior and contemporaneous understandings, agreements, representations, and warranties (both written and oral) regarding the Site. You acknowledge that you have not relied on any statement, representation, or promise not expressly outlined in these Terms.

Transfer and Assignment: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to another party (for example, if ownership of the Site changes or as part of an organizational restructuring) without notice to you. Force Majeure: We will not be liable for any delay or failure to perform any obligation under these Terms if the delay or failure is due to unforeseen events beyond our reasonable control, such as acts of God, war, terrorism, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
